HOW TO GET MALTA CITIZENSHIP

How to Become a Maltese Citizen

It is possible to become a Maltese citizen in several ways;

1. Citizenship by Investment

A program called Exceptional Services by Direct Investment is responsible for this initiative. The fastest way for a high-net-worth individual to become a citizen of Malta is to invest in the country’s economy. Between 2014 and 2020, Malta had the Individual Investor Program, which was recognized by the European Commission as a “golden standard” in citizenship by investment.

An investor can apply for citizenship for the entire family at once. Before or after obtaining a passport, you do not have to know the language, pass exams, or live permanently in the country. Citizenship can be obtained within 14 or 36 months, depending on the amount invested.

2. Citizenship by Marriage

It is also possible to become a Maltese citizen by marrying a Maltese citizen. In Malta, foreigners who are married to Maltese citizens are entitled to live visa-free and work without a work permit. After five years of marriage, you can apply for citizenship. Malta prohibits such marriages. Those who marry solely for citizenship may be fined or imprisoned for two years.

3. Citizenship by Naturalization

Taking at least seven years, naturalization is the longest route to citizenship. A foreign national without family ties to Malta can become a citizen after living in the country for four cumulative years in the past six years. In the said period, they cannot have spent more than six consecutive months or ten consecutive months outside Malta. A period of 12 years will also be required after the application has been submitted for them to live continuously in Malta.  The process of naturalization is therefore suitable only for Malta residents who don’t intend to leave the country.

4. Citizenship by Birth

Despite the fact that this process cannot be opted in or out, it’s still worth mentioning. Citizenship by birth was introduced into the Maltese constitution on September 21, 1964. In the Independence Constitution, Malta recognizes its citizens as citizens by birth.  Previously, the constitution stated that any person born on Maltese soil is a citizen of Malta from birth. However, anyone born on or after August 1, 1989 shall only be entitled to Maltese citizenship if either of their parents were citizens of Malta.

5. Citizenship by Family Reunification

The program is ideal for children with close family ties to Malta or those who have held Maltese citizenship at some point in their lives. You can only obtain citizenship by family reunification if you were born in Malta in 1989 and had at least one Maltese parent. Additionally, this applies to those born outside Malta with a Maltese father between September 21, 1964, and July 31, 1989.

6. Citizenship for Refugees and Political Asylum

The number of refugees arriving in Malta each year ranges from 8,000 to 9,000, most of whom come from Africa and the Middle East. It is more likely that a forced option will be employed. State officials do not charge refugees any fees or require them to take any tests. However, they must prove that their lives have been threatened or that they have been discriminated against. A refugee can become a citizen of Malta after living there for six years.

7. Citizenship for Distinguished Service to Malta

Science, culture, business, politicians, and athletes receive passports from Malta’s President. Generally, this method of gaining Maltese citizenship cannot be planned in advance, since there is no clear criterion for determining whether a merit is exceptional.

Process of Obtaining Malta Citizenship by Investment

Malta citizenship is achieved through Exceptional Services by Direct Investment, a four-step process.

Stage 1: Residency in Malta

An application for a Maltese residence card must be filed by the main applicant and any dependents included in the application. A thorough due diligence check must be passed before you are eligible for a residence card from CMA. The residence card you receive is valid for 36 months if you are approved. Then, you must visit Malta (young children excluded) to collect bio-metric data for the residence card. Your apartment must be leased before you can submit your residence application.

Stage 2: Eligibility for Citizenship

The CMA will revoke the card if an application for citizenship eligibility is not submitted within 12 months of issuance. As usual, the CMA performs due diligence to ensure the application is handled correctly. Documents and further information may be requested. The CMA then presents the application to the Minister, who decides whether applicants are eligible for citizenship.

Stage 3: Maltese Citizenship

After 12 months or 36 months from your residency stage, you can submit your Malta citizenship application to the CMA. The CMA updates its due diligence on the applicants and presents its final findings to the Minister. Basically, your application depends on whether the Minister approves it or not. Once approved, citizenship is granted.

Stage 4: Naturalization

Upon meeting all investment requirements, the main applicant and any dependents included in the application will be invited to Malta to take the Oath of Allegiance. Within six months of receiving the Letter of Approval in Principle, the Oath of Allegiance must be taken. All naturalized persons’ names will be published in the Government Gazette every year.

Monitoring

A five-year continuous monitoring program is conducted by the CMA. In the event that you do not comply with the requirements of the program, your Maltese citizenship could be revoked
